[UPDATED with More Details:] Newport Beach Film Festival May Seek Legal Action Against Andy Dick


UPDATE, MAY 16, 8:57 A.M.: More details have been released about the April 29 incident that resulted in the Newport Beach Film Festival (NBFF) considering taking legal action against troubled comic actor Andy Dick.

The piss-destroy-chew episode (see original post after the jump) happened just after midnight at the first NBFF Friday night party hosted at the Newport Lexus dealership. According to the NBFF, Dick wrecked a new booth that must be replaced.

However, festival officials have not reached a final decision regarding legal action, saying they are working with Dick's people directly to resolve the matter.

More information has also been released about Dick's other
recent run-ins. As mentioned below, days after the festival party incident, Dick was booked
on suspicion of public intoxication at a Marie Callender's in Temecula.
He was released after posting $500 bail and still must answer to that charge. As for the 2008 bust for drug possession
and sexual battery after a flare-up in a restaurant in neighboring Murrietta, Dick received probation.

And his problems in bars last year was not confined to the state
of Texas (see details below). Dick was also charged last year with
sexual abuse over allegations that he groped a bouncer at a West
Virginia bar.


UPDATE, MAY 13, 2:26 P.M.: In my original post, I mentioned a podcast interview with Andy Dick that I heard shortly before learning the Newport Beach Film Festival is planning action against the comic actor.

Dick, whose adoptive parents passed away years ago, mentioned a mini-tour of Texas, the home state of his estranged biological father, that did not go well months before.

WTF podcast host Marc Maron assumed Dick was referring to more friction with his dad, but the video after the jump shows the real reason one particular show did not go well . . .

As Robert Wilonsky blogs for the Dallas Observer, our Village Voice Media sister site alt. weekly, at about the three-minute mark an incident occurs that was parlayed into a lawsuit against Dick six months after the fact by a lounge patron. What is alleged to have happened is described in court papers thusly:

As Andy Dick walked through the audience, he approached where Plaintiff
was seated, and Plaintiff asked Andy Dick for his autograph. Andy Dick
told Plaintiff to “hold on a minute” and pulled a barstool next to
Plaintiff. Andy Dick then grabbed Plaintiff's head and shoulders to
raise himself on top of the barstool. Andy Dick then took control of
Plaintiff's head with his left hand and pulled down his costume skirt
with his right hand, exposing the fact that he was not wearing underwear
beneath the skirt. Defendant Dick then, while still controlling
Plaintiff's head wth his hand forced his genitals against the left side
of Plaintiff's dace. Plaintiff immediately pulled away. Andy Dick
returned to the stage with the help of Defendant's employees.

AndyDick.com leads with item suggesting Dick would be a great substitute for Charlie Sheen on Two and a Half Men (unfortunately for him, the CBS shows producers just announced Ashton Kutcher will be taking over the role). But the way things are going, maybe Sheen should play Dick.

ORIGINAL POST, MAY 13, 10:52 A.M.: The Newport Beach Film Festival will take some kind of legal action against comic actor Andy Dick, who allegedly exposed himself in public and urinated on private property at an April 29 festival party he crashed.

A festival official this morning confirmed for the Weekly a report carried on a popular Hollywood gossip site. More details to come.

reports the festival plans to file a complaint alleging Dick damaged property. The post quotes partygoers claiming: Dick “was completely out of control, beyond drunk”; that just past midnight he unzipped his pants, took out his junk and started rubbing himself against a table; that he then went inside a display booth, peed and then tore the booth down; and that he chewed on decorative rubber plants.


This was days before the 45-year-old was arrested for public intoxication at a Marie
Callender's in Temecula. Three years earlier, he was arrested in nearby Murrieta for alleged drug possession and sexual battery on a 17-year-old girl. These are but two of several incidents over the years involving Dick, alcohol and drugs.

On his Twitter page, Dick writes that last week was bad but this week is better. Among his tweets he also mentions having lost his iPhone at an Italian restaurant in Murrieta around the time of his latest arrest.

Ironically, about an hour before stumbling upon the RadarOnline item this morning, I was listening to Marc Maron's WTF podcast with guest Dick that was posted April 28. During the brutally honest conversation, Dick talked about his struggles with sobriety, his bisexuality and his family dynamics, noting at least at that time that he was living in a shed behind the home of his former wife and kids.

Saying that he continues to work with Dr. Drew Pinsky and various sponsors and that he's been in rehab 11 times, Dick mentioned that he had come to the conclusion that he just cannot consume alcohol anymore because he eventually overindulges, blacks out and does stupid shit. He also boasted of an ability to go weeks, months, even years without drinking, and claimed addiction is not a disease.

People don't laugh at victims of a disease, he explained, but they laugh at him all the time when they learn of his latest antics while fucked-up.
