[UPDATED:] Minh Anh Nguyen, Girls Volleyball Coach No Longer Facing Charges of Exposing Player's Vagina and Breasts


Update, December 8, tk p.m.: Charges have been dismissed against 36-year-old Sacramento volleyball coach Minh Anh Nguyen, who had been accused of sexually touching a player while giving the teen girl a massage in a Santa Ana hotel last December.

Two previous juries failed to reach unanimous verdicts in the trials of Nguyen, who each time pleaded not guilty to touching the teen in a
sexual manner.

Faced with that, prosecutors decided not to pursue a third trial against Nguyen, who had been charged with one count of molesting a child.

The Christian Brothers High School coach had been in Santa Ana to play in the California Interscholastic Federation Division IV state championship match.

Updated Post, November 3, 7:53 a.m.: A mistrial has been declared in the trial against a 36-year-old male Sacramento Christian high school teacher and girls
volleyball coach who was accused of touching a 17-year-old girl's forehead with his penis, pushing her sweatpants and underwear down and lifting her bra.

Minh Anh Nguyen, who was charged with one
misdemeanor count of child
annoyance, could have received a year in jail if convicted.

The events that led to the charges were said to have occurred in a Santa Ana hotel while
Sacramento's Christian Brothers High School was in Orange County for a
Dec. 5 championship volleyball game at UC Irvine.

Nguyen was giving the volleyball player an athletic massage in her room about 10:20 p.m. Dec. 4 when the incident occurred, according to prosecutors.

But the jury failed to reach a verdict Monday and a mistrial was
declared. A previous jury had failed to reach a verdict July 22 and a mistrial was declared in that trial as well.

Nguyen is due in court Nov. 17 for a pretrial hearing on the third effort by the Orange County District Attorney's Office to secure a conviction.

Original Post, February 3, 8:51 a.m.: A 36-year-old male Sacramento Christian high school teacher and girls volleyball coach could get up to a year in the pokey after allegedly exposing a 17-year-old player's vagina and breasts in the midst of what was supposed to be an athletic massage.

annoyance–is said to have occurred in a Santa Ana hotel while Sacramento's Christian Brothers High School was in Orange County for a Dec. 5 championship volleyball game at UC Irvine.

SANTA ANA – A Sacramento Christian high school teacher who coached
volleyball has been charged with one misdemeanor count of child
annoyance for exposing a 17-year-old female player's vagina and breasts
by moving her clothing while massaging her. The team was in Orange
County for a high school volleyball championship game. Minh Anh Nguyen,
36, was charged yesterday, Feb. 1. 2010, and faces a maximum sentence
of one year in jail if convicted. Nguyen is expected to be arraigned
Feb. 25, 2010, at the Central Justice Center in Santa Ana. The time and
Department are to be determined.




At the time of the incident, Nguyen is accused of being a teacher and
girls' volleyball coach at Christian Brothers High School in
Sacramento. In December 2009, the defendant is accused of traveling to
Orange County with the girls' varsity volleyball team for a
championship game to be played at the University of California, Irvine
on Dec. 5, 2009. The team was staying at the Embassy Suites on Dyer
Road in Santa Ana.




At approximately 10:20 p.m. on Dec. 4, 2009, the defendant is accused
of going to the hotel room of 17-year-old Jane Doe, a varsity player on
the volleyball team, under the pretense of giving her an athletic
massage. Nguyen is accused of instructing Jane Doe to lie on the floor
and kneeling over the victim with his knees behind her head. He is
accused of leaning over the victim to rub her hip flexors and striking
her forehead with his penis. The defendant and the victim were both
clothed.




As Nguyen kneeled over the victim, he is accused of pushing Jane Doe's
sweatpants and underwear down, exposing her vagina. He is accused of
then lifting Jane Doe's bra and exposing her breasts. Nguyen did not
touch the victim's vagina or breasts.
