An off-duty Los Angeles County sheriff's
deputy has been charged with two separate crimes involving lies and gunfire: filing a false report with Huntington Beach Police accusing her ex-husband of sexually assaulting their 13-year-old daughter and firing a firearm in her Westminster home, endangering
children playing nearby.

Patricia Margaret Bojorquez, 43, of Westminster,
is scheduled to be arraigned Sept. 24 on one felony count of discharging a
firearm with gross negligence which could have resulted in injury or
death to a person and one misdemeanor count of falsely reporting a
crime. She could get up to three years in
state prison if convicted.

OFF-DUTY LOS ANGELES COUNTY SHERIFF'S DEPUTY ON DUI PROBATION CHARGED
WITH SHOOTING FIREARM INSIDE HOME AND FILING FALSE REPORT AGAINST
EX-HUSBAND

WESTMINSTER – An off-duty deputy with the Los Angeles County Sheriff's
Department has been charged with filing a false police report against
her ex-husband and firing a firearm in her Westminster home, endangering
children playing nearby. Patricia Margaret Bojorquez, 43, Westminster,
was charged Aug. 26, 2010, with one felony count of discharging a
firearm with gross negligence which could have resulted in injury or
death to a person and one misdemeanor count of falsely reporting a
crime. If convicted, she faces a maximum sentence of three years in
state prison. Bojorquez is scheduled to be arraigned on Sept. 24, 2010,
in Department W-2, West Justice Center, Westminster.

On Nov. 18, 2009, Bojorquez is accused of calling the Huntington Beach
Police Department (HBPD) Dispatch and falsely reporting that her
ex-husband was sexually assaulting a 13-year-old female relative. The
defendant is accused of lying about the sexual assault because she was
upset over child custody issues. Responding HBPD officers investigated
the report and determined that the 13-year-old girl had not been
molested and had made no such representation to the defendant.

At approximately 11:50 a.m. on Jan. 9, 2010, Bojorquez is accused of
firing a firearm inside her Westminster home. She is accused of shooting
a bullet that pierced a bedroom window and exited the home toward a
residential street where children were playing in the front yards of
their homes. Bojorquez is accused of showing a disregard for the safety
of the children outside, who were directly in the line of fire. The
defendant's brother and fiancé were in the house at the time and called
the police. The Westminster Police Department investigated this case.

The defendant is currently on probation for two driving under the influence (DUI) convictions in Orange County.

On Aug. 10, 2009, Bojorquez pleaded guilty to a court
offer to one misdemeanor count each of driving under the influence of
alcohol and driving with a blood alcohol of .08 percent or more. She
pleaded no contest to one misdemeanor count of child endangerment by a
caretaker. She was sentenced to 10 days in jail and ordered to complete a
6-month first-offender alcohol program, Mothers Against Drunk Driving
(MADD) Victim's Impact Panel, and Child Abuser's Treatment Program. In
this case, the defendant was driving her two children on April 12, 2009,
to the parking lot at the Block at Orange to drop them off with their
father. Bojorquez was under the influence of alcohol while driving and
had a .19 blood alcohol level. Upon arriving in the parking lot, one of
the defendant's children reported her drunken driving to a police
officer, who happened to also be in the parking lot. The officer
observed Bojorquez speed away through the parking lot before stopping
her for DUI.

On April 15, 2010, Bojorquez pleaded guilty to a court
offer to one misdemeanor count each of driving under the influence of
alcohol and driving with a blood alcohol of .08 percent or more with a
prior conviction. She was sentenced to 55 days in jail, 30 days
residential program, 60-day outpatient treatment program, five years
probation, and ordered to complete an  18-month multiple offender
alcohol awareness program and MADD Victim's Impact Panel. In this case,
the defendant was leaving a strip mall in Huntington Beach at
approximately 2:30 p.m. on Nov. 19, 2009. Bojorquez was driving under
the influence of alcohol and had a blood alcohol level of .27 percent.
The defendant backed into a parked car and then began to slowly drive
through the parking lot. A witness knocked on the window of Bojorquez's
slowly moving car and asked her to get out. The defendant was naked from
the waist down and had an open bottle of wine in the center console cup
holder in her car.

WESTMINSTER – Una asistente en el Departamento del Alguacil del Condado
de Los Ángeles ha sido acusada de registrar un reporte falso  contra su
ex esposo con la policía y de disparar un arma en su casa en
Westminster, poniendo en peligro a niños jugando en la vecindad.
Patricia Margaret Bojorquez, 43, de Westminster, fue acusada el 26 de
agosto del 2010, de un cargo de delito grave por descargar un arma con
negligencia completa cual pudo resultar en daño corporal o muerte a
otro, y un cargo de delito menor por registrar un reporte criminal
falso. Si es condenado de los cargos, ella enfrentará una sentencia
máxima de tres años en prisión estatal. Se espera que Bojorquez se
presente en corte para ser instruida de cargos el 24 de septiembre del
2010, en el departamento W-2, en West Justice Center de la ciudad de
Westminster.

El 18 de noviembre del 2009, Bojorquez es acusada de llamar al despacho
del Departamento de Policía de Huntington Beach (HBPD), y reportar
falsamente que su ex esposo abuso sexualmente de un familiar de 13 años
de edad. Ella es acusada de mentir del abuso sexual porque estaba
molesta sobre asuntos de custodia de sus hijos. La policía de HBPD que
respondió a la llamada investigo el reporte y determino que la niña de
13 años de edad no fue abusada y que nunca declaro una queja de ese tipo
a Bojorquez. 

Alrededor de las 11:50 de la mañana, el 9 de enero del 2010, Bojorquez
es acusada de disparar un arma dentro de su casa en Westminster. Ella es
acusada de disparar una bala que penetro la ventana de su cuarto,
siguiendo rumbo fuera del la casa hacia una calle residencial donde
niños estaban jugando en los patios enfrente de sus casas. Bojorquez es
acusada de ensenar una indiferencia a la seguridad de los niños jugando
afuera, quienes estaban directamente en línea de fuego. El hermano y
novio de la acusada estaban en casa en ese entonces y llamaron a la
policía. El Departamento de Policía de Westminster investigo este caso.

La acusada esta bajo libertad condicional por dos convicciones de conducir bajo la influencia (DUI) en el Condado de Orange.

El 10 de agosto del 2009, Bojorquez se declare culpable a una oferta de la corte de un cargo de delito menor por
conducir bajo la influencia de alcohol y conducir con un nivel de más de
.08 por ciento de alcohol en la sangre. Ella no acepto ni negó el cargo
de poner en peligro a un menor de edad por un guardián. Bojorquez fue
sentenciada a 10 días de cárcel y fue instruida a que termine un
programa sobre alcohol de seis meses ofrecido solo por la primera
ofensa, y dos otros, Mothers Against Drunk Driving (MADD) Victim's
Impact Panel, y Child Abuser's Treatment Program. En este caso, el 12 de
abril del 2009, la acusada iba manejando en su carro con sus dos hijos
en el estacionamiento del Block at Orange para entregarlos al padre.
Bojorquez estaba conduciendo bajo la influencia de alcohol y tenía un
nivel de .19 porciento de alcohol en la sangre. Cuando llego al
estacionamiento, uno de los hijos de la acusada reporto a un policía
quien estaba en el estacionamiento, que su madre estaba conduciendo
embriagada. El policía observo a Bojorquez manejando rápidamente por el
estacionamiento antes de pararla por DUI.

El 15 de abril del 2010, Bojorquez se declare culpable a una oferta de la corte de un cargo de delito menor por conducir bajo
la influencia de alcohol y conducir con un nivel de más de .08 porciento
de alcohol en la sangre. Ella fue sentenciada a 55 días de cárcel, 30
días en un programa residencial, un programa de 60 días de tratamiento
como paciente externo, cinco años de libertad condicional, y fue
instruida a que termine un programa sobre alcohol de 18 meses ofrecido
por ofensas múltiples, y el programa MADD Victim's Impact Panel. En este
caso, la acusada se iba de un centro comercial en Huntington Beach
alrededor de las 2:30 de la tarde el 19 de noviembre del 2009. Bojorquez
conducía bajo la influencia de alcohol y tenía un nivel de .27
porciento de alcohol en la sangre. La acusada hecho su carro en reversa,
chocando contra otro carro estacionado y continuo manejando despacio
por el estacionamiento. Un testigo toco la ventana del carro de
Bojorquez mientras ella manejaba despacio y le pidió que salga del
vehículo. La acusada estaba desnuda de la cintura a los pies, y tenía
una botella de vino abierta dentro de su carro entre los asientos. 

El caso será procesado por la fiscal asistente mayor Rebecca Olivieri de la Unidad de Procesamiento Especial.
