Nicole Ethel McMillen had remained out of custody since being convicted Oct. 16 of sexually assaulting her son's 14-year-old friend and the 16-year-old son of one of her own friends.
But life on the outside ended Friday for the 43-year-old Irvine mother of three, who was taken into custody to begin a three-month evaluation aimed at determining whether she should be eligible for probation.

Orange County Superior Court Judge James Rogan ruled McMillen will return to court April 11, at which time probation officials will begin considering whether she can qualify for probation.
Deputy District Attorney Whitney Bokosky has recommended seven years in state prison, the maximum punishment McMillen faces after a jury found her guilty of four counts of lewd acts on a child 14 or 15 years old, two counts of oral copulation of a victim younger than 16, and a count of oral copulation of a victim younger than 18. She may also have to register as a sex offender for life.
Bokosky had objected to Judge Rogan allowing McMillen to remain free on $100,000 bail after her conviction.
Between Jan. 1-Feb. 28, 2012, McMillen had repeated sexual contact with the 14-year-old boy who came to her house to play with her son, fondling his groin area over his clothing, touching his penis directly and giving him oral during two visits. He wound up telling his mother what had happened, which led to an Irvine Police investigation.
That probe produced a 26-year-old man who, when he was 16, had a sexual relationship with McMillen for more than a year between 2005-06. She orally copulated that boy, a friend's son she had known since he was 10, at least once during sexual encounters in her home or at motels.
During the crimes, McMillen worked part time at an elementary school, but no allegations have been made involving children who were at that campus at the time.
