Jose Carmen Sian Faces 40 Years to Life for Allegedly Getting 12 y.o. Girl Pregnant: Update

ORIGINAL POST, AUG. 11, 9:55 A.M.: A man who is believed to have fled Orange County to avoid prosecution has been returned from Guatemala to Santa Ana, where he faces charges for allegedly assaulting his girlfriend's 12-year-old daughter sexually and continuously for two years and getting her pregnant.

Jose Sian, 42, had lived with the mother a daughter before the girl reported the alleged abuse in June of 2009, according to the Santa Ana Police Department, which adds that, “Immediately after the disclosure, Sian fled to Guatemala, presumably to avoid prosecution.”

The Orange County District Attorney's office issued a warrant for Sian's arrest for alleged continuous sexual abuse and sexual intercourse with a child 10 years or younger.

Agencies on both sides of the border worked together to arrest and extradite Sian, according to a Santa Ana police statement.

The FBI delivered Sian to Santa Ana police detectives on Thursday, at which time he was booked into the city jail on the outstanding warrant.

UPDATE, AUG. 13, 9:44 A.M.: Jose Carmen Sian faces a maximum punishment of 40 years to life in state prison if he is convicted of the current charges against him, according to the Orange County District Attorney's office (OCDA).

Sian faces one felony count each of sexual intercourse with a child age 10 years or younger and continuous sexual abuse, and sentencing enhancement allegations for substantial sexual conduct with a child and causing great bodily injury as a result of sexual assault.

His continued arraignment hearing is scheduled for Aug. 29 in Santa Ana.
