Hawaiian BBQ Legal Battle Over “Ono” Settles in Federal Court


A federal judge in Orange County last week approved of a consent judgment and permanent injunction against a businesswoman who violated a federal trademark belonging to S & S Hawaii BBQ.

U.S. District Court Judge Andrew J. Guilford declared that S & S clearly controls the rights to “Ono Hawaiian BBQ” (including a few variations) and that Carrie Lutke had infringed upon those rights by naming her businesses Ono Means Delicious.
According to Guilford, Lutke's use of “Ono” could have easily confused consumers and potentially harmed S & S in the marketplace.

S & S lawyers at Nixon Peabody LLP in San Francisco filed their federal lawsuit against Lutke in Orange County in November 2012.
The settlement terms between the parties is confidential and Lutke has reportedly sold her business, according to records inside the Ronald Reagan Federal Courthouse in Santa Ana.
