Eve Himmelheber and Evelyn Carol Case Sue CSUF for Alleged Gender Discrimination

Two instructors from the Department of Theater and Dance have filed gender discrimination lawsuits against Cal State Fullerton in Orange County Superior Court. Eve Himmelheber and Evelyn Carol Case allege they unjustly earn less pay than male instructors with similar jobs and experience.


“Men in the department make more than them,” Vincent Howard, the attorney representing the women, reportedly told the Orange County Register. “This isn't 1940 anymore; employers are not allowed to pay women less than men for essentially performing the same services.”

The university declined comment citing the pending litigation.

Case and Himmelheber discovered a “significant” pay discrepancy between themselves and males co-workers when they reviewed online state databases of public employee salaries in 2013, the Register reports.

The instructors claim to have alerted the College of Fine Arts dean without any action being taken. Their suits accuse CSUF of violating the state's Equal Pay Act.

Himmelheber joined the university in 2004. Case has been there since 1992.
