A federal judge today dismissed the drug case against billionaire Broadcom co-founder Henry T. Nicholas III.
Government prosecutors sought to dismiss the drug indictment after U.S. District Judge Cormac Carney in Santa Ana expressed fears of prosecutorial misconduct while dismissing securities-fraud charges against Nicholas last month.
Carney has already dismissed charges in the wide-reaching case against Broadcom's other co-founder and Anaheim Ducks owner Henry Samueli, ex-chief financial officer William
J. Ruehle and former human resources vice president Nancy Tullos.

Broadcom's CEO from 1998 to 2003, Nicholas was
indicted in June 2008 on charges of conspiring to distribute illegal
drugs, including methamphetamine and cocaine.
Today, Carney said from the bench that Nicholas' reputation has been destroyed by the case.
“It
appears that you had a serious drug problem, you paid dearly for that,
lost your family and job,'' Carney told Nicholas, according to an Orange County Register report.
