Already a prison veteran and lifetime registered sex offender for convictions in 2006 for using a minor to create pornography and 2003 for unlawful sexual intercourse with a minor three years younger than he was, Phernambucq in December 2012 met a 17-year-old boy via Facebook, telling the lad he was a pornography director who wanted the teen in his film.

In January, Phernambucq met the 17-year-old in the abandoned house, where he was instructed to strip. The older man then orally copulated the teen, who became uncomfortable and left. Later learning Phernambucq is a registered sex offender, the boy told his family, who contacted Anaheim Police.
