Stillittano: Webcam superstar
Can you imagine the shock on Jeffrey Andrew Stillittano's face when he learned that he'd jacked off three times in two days on his webcam for Jamie, a 13-year-old girl who was, in fact, a fictitious character being played by undercover vice squad cops at the Anaheim police department?
Stillittano, a resident of Redondo Beach, found Jamie in an internet chat room, claimed he was 20 years old when he was 30, and proceeded to dirty talk after the girl said she was just 13.
He asked the child if she was naked, wet and touching herself, and turned on his webcam. He then exposed his penis, masturbated vigorously and ejaculated twice during the session.
The next day, Stillittano masturbated for her again on the webcam and, while making plans to meet at a hotel, ejaculated for a third time.
He never followed through with a meeting, but police, who had him under surveillance, charged him with two counts of attempting to commit a lewd act on a child under 14 and two counts of attempting to distribute harmful material to a minor. Interestingly, Aleta Bryant, a veteran Orange County prosecutor, argued Stillittano was guilty of "constructive touching" of the imaginary minor because, even though he was never in her physical presence, he had figuratively touched her by encouraging her to touch herself.
A 2009 jury agreed with Bryant, found Stillittano guilty on all counts, and Superior Court Judge Gregg L. Prickett sentenced him to prison.
But Stillittano appealed, arguing that he could not be guilty of attempting to commit a lewd act because he "did not implement a concrete criminal plan to physically touch Jamie."
This week, a California Court of Appeal based in Santa Ana rejected Stillittano's claim.
"There is ample evidence that [Stillittano] specifically intended to commit a lewd act on a child under the age of 14," wrote Justice William W. Bedsworth for a three-justice panel that included William F. Rylaarsdam and Kathleen O'Leary. "At the outset of his internet chat with Jamie, he asked her old she was, and was told she was only 13. Nonetheless, he persuaded her to engage in 'cyber sex' and encouraged her to touch her own genitalia. He also talked about how he wanted to 'fuck' her while he was masturbating in front of his webcam. There can be no question he had the requisite intent to arouse, appeal to, or gratify his sexual desires or those of the victim."
Upshot: Stillittano, now 35, will continue to serve his six-year prison sentence and then faces formal probation for another five years when he emerges from custody.
