[UPDATED with Charges:] Nicole Gutierrez, OC Homicide No. 41: Boyfriend Samuel Oscar Montes Held for Her Murder


UPDATE, AUG. 31, 9:47 A.M.: Police say Samuel Oscar Montes' 3-year-old boy, 1-year-old girl and 1-month-old boy were near Nicole Gutierrez when the man allegedly shot and killed their 20-year-old mother–and his girlfriend–at their Anaheim residence Saturday afternoon.

Montes, also 20, has been charged with one felony count each of murder, use of a firearm and possession of a
controlled substance and three felony counts of child abuse and
endangerment.

He is scheduled to be arraigned Sept. 16.

Police have not yet determined the motive for the shooting.

Montes had methamphetamine on him at the time of his arrest.


ORIGINAL POST, AUG. 29, 9:18 A.M.: Details are sketchy, but the boyfriend of a 20-year-old woman is being
held for shooting her to death in Anaheim Saturday afternoon.

Police received a call of shots fired just before 2:30 p.m. from a residence in the 2100
block of East Banyan Street. Emergency personnel found Nicole Gutierrez suffering from gunshot wounds and pronounced her dead at the scene.

“Initial investigation indicated Gutierrez's boyfriend, Samuel Oscar Montes, had been at the scene at the time of
the shooting but fled prior to the arrival of emergency personnel,” reads a statement from Anaheim Police Sgt. Bob Dunn. “He was later contacted, interviewed,
and arrested for her murder.”

Montes, 20, was booked at the Anaheim Police Department Detention Facility for murder with a bail of $1 million, according to the statement.

Court records indicate Montes is to be arraigned Tuesday.
