Kathia Maria Davis, Boy-Banging Hockey Mom, Sees Second Mistrial in Case Involving 13 Y.O.
Here's another one that happened while I was out of the office last week: a second mistrial was declared in the case that alleges a Laguna Niguel hockey mom sexually assaulted her son's 13-year-old friend.
Prosecutors must now decide whether to seek a third trial against 45-year-old Kathia Maria Davis, who was convicted in August of having sex with a 16-year-old boy.
Orange County Superior Court Judge W. Michael Hayes called the mistrial Thursday after the jury deadlocked 10-2. As was the case the first time, jurors must vote unanimously for their to be a conviction.
The Orange County Sheriff's Department investigated and later arrested Davis after receiving complaints she was plying players on her son's Beach City Lightning hockey team with alcohol and, in at least two cases, having sex with them.
Once between April 30, 2005, and April 29, 2006, Davis allegedly let her son and the 13-year-old drink alcohol in her home during a sleepover, when the mom is accused of having kissed and given the visitor a hand job while her son slept.
Davis testified she believed the boy to be 18 and the sex act consensual.
The case came to light after the 16-year-old told his mother he had consensual sex with Davis. The sheriff's department was called, and the probe was launched that led to her arrest and prosecution.
The divorcee faces up to five years in prison and having to register as a sex offender for the crime that won a conviction against her.
