Joseph Edward Delariva Goes From Hospital to Court After Being Shot by Cop

A 33-year-old man who was critically injured in an officer-involved shooting in Anaheim on Sunday is scheduled to be arraigned today on two felony counts of kidnapping and two felony counts of aggravated assault with a sentencing enhancement allegation for the personal use of a knife, prosecutors say.

Joseph Edward Delariva of Tustin could go away to prison for 13 years if convicted, according to the Orange County District Attorney’s office, which is also investigating the officer-involved shooting.

Delariva is accused of arming himself with a knife and trying to rob a Subway sandwich shop at 1131 W. Lincoln Ave. One of two female employees there called 9-1-1 around 2 p.m. Sunday and whispered something unintelligible, according to Anaheim Police Sgt. Daron Wyatt.

Officers arrived to find a man holding a knife and menacing the women, prompting the cops to rush inside where “an officer-involved shooting ensued,” Wyatt said.

The suspect, later identified by the OCDA as Delariva, was struck and officers immediately rendered medical aid until Anaheim paramedics took over and took him to a local hospital, where he was listed in critical condition. 

The OCDA says the time of Delariva’s arraignment will depend on when he is discharged.

No employees or officers were hurt in the incident, and no customers were inside at the time, according to Wyatt, who added footage captured on the cops’ body worn cameras will be turned over to prosecutors for their investigation. Officer involved shooting reports typically take months to complete.
